Terms of Service

1. Acceptance of these Terms

By creating an account or using Zenly Penlo (the "App") you agree to these Terms of Service. If you don't agree, please don't use the App. The App is operated by TechSmart ("we", "us").

2. Eligibility

You must be at least 13 years old to use Zenly Penlo. If you are under the age of majority where you live, your parent or legal guardian must agree to these Terms on your behalf.

3. Your account

• You are responsible for safeguarding your account credentials.
• One account per person — don't create multiple accounts.
• You must provide accurate information during signup.
• You're responsible for activity on your account.

4. Acceptable use

You agree NOT to use Zenly Penlo to:

• Impersonate any person or entity
• Stalk, harass, threaten, or intimidate other users
• Share illegal, harmful, hateful, sexually explicit, or violent content
• Reverse-engineer, decompile, scrape, or attempt to derive source code
• Use the App to surveil another person without their informed consent
• Send unsolicited bulk SMS invites (spam) via our invite features
• Interfere with or disrupt the App's servers or networks
• Use automation, bots, or scripted access

We may suspend or terminate accounts that violate these rules.

5. Your content (Moments and shared data)

You retain ownership of photos, status updates, and other content you upload to Zenly Penlo. By uploading, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display your content to your friends as part of the App's normal operation. This license ends when you delete the content or your account, except for backups we may retain for a short period for operational reasons.

6. Our intellectual property

The Zenly Penlo app, name, logo, and visual design are owned by TechSmart and protected by copyright and trademark law. You may not copy, redistribute, or use them without our written permission, except for sharing app-store install links or screenshots in their original form.

7. Premium subscriptions

• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• You can cancel anytime via your App Store / Google Play subscription settings.
• No refunds for partial billing periods, except where required by local law.
• Premium features are subject to change; significant removals will be communicated in-app.

8. Termination

We may suspend or terminate your account if you violate these Terms or the law. You can delete your account anytime via Settings → Account → Delete Account. After deletion we remove your data per our Privacy Policy.

9. Disclaimer of warranties

Zenly Penlo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We don't guarantee uninterrupted service, perfect location accuracy, or that bugs will be fixed within a specific timeframe.

10. Limitation of liability

To the maximum extent permitted by law, TechSmart and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the App. Our total aggregate liability for any claim related to the App will not exceed the amount you paid us in the 12 months prior to the claim.

11. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict of laws principles. Any dispute arising from these Terms or your use of the App will be resolved in the competent courts of Ho Chi Minh City, Vietnam.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you in-app of material changes and update the "Last updated" date above. Continued use of the App after changes means you accept the updated Terms.
